Welcome to GasLite. These Terms of Service (“Terms”) govern your access to and use of the GasLite website, mobile applications, and related services (collectively, the “Services”). By creating an account, placing an order, or otherwise using our Services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. About GasLite

GasLite is a technology platform that connects customers seeking LPG (liquefied petroleum gas) refills or deliveries with independent, licensed delivery drivers and participating gas suppliers. GasLite does not sell, refill, or store LPG cylinders and is not responsible for the physical handling, safety, or storage of LPG products. All deliveries are fulfilled by independent third parties.

2. Use of the Service

You agree to use the Services for lawful purposes only and in compliance with all applicable South African laws and regulations, including the Consumer Protection Act, Occupational Health and Safety Act, and Protection of Personal Information Act (POPIA). You must not:

• Engage in any illegal, fraudulent, or unsafe use of LPG or the platform;
• Interfere with or disrupt the functionality of the Service;
• Misuse GasLite’s intellectual property, name, or branding;
• Attempt to access accounts or data without authorization.

3. Eligibility and Accounts

• You must be at least 18 years old and legally capable of entering into binding contracts.
• When creating an account, you agree to provide accurate, current, and complete information.
• You are responsible for safeguarding your password and account credentials.
• GasLite reserves the right to suspend or terminate any account for violations of these Terms, non-payment, or suspected fraudulent activity.

4. Orders, Pricing, and Payments

• By placing an order through the GasLite platform, you agree to pay the total amount displayed at checkout, including applicable delivery fees (R29) and service fees (2.75%).
• All prices are subject to change without notice due to market fluctuations, supplier costs, or fuel surcharges.
• Payments are securely processed through a third-party payment provider, and their terms and privacy policies will apply to your transaction.
• You authorize GasLite to share relevant transaction information with that provider as needed to complete payment.

5. Deliveries and Fulfilment

• Delivery times are estimates and not guaranteed.
• Drivers are responsible for the physical handover and verification of cylinders at delivery.
• In cases of delays, stock shortages, or other unforeseen issues, GasLite will make reasonable efforts to notify you.
• GasLite is not liable for any indirect loss or inconvenience caused by delayed or failed deliveries.

6. Independent Drivers

All deliveries are carried out by independent contractors, not employees or agents of GasLite. Drivers control their schedules, vehicles, and delivery methods. GasLite does not supervise or control driver conduct and assumes no responsibility for any loss, damage, or injury arising from their actions or omissions.

7. Safety Disclaimer

Handling LPG gas cylinders involves inherent safety risks. You agree to:

• Use and store LPG cylinders in accordance with all safety standards and manufacturer instructions;
• Not tamper with, refill, or connect cylinders improperly;
• Immediately report suspected leaks or hazards to emergency services and your gas supplier.

GasLite is not liable for any injury, damage, or loss resulting from improper use, storage, or handling of LPG cylinders by customers, drivers, or suppliers.

8. Cancellations and Refunds

• Orders may be cancelled before a driver has accepted the delivery request.
• Once accepted by a driver, cancellations may incur a fee.
• Refunds will be processed only where GasLite determines that a valid claim exists (e.g., wrong or damaged cylinder delivered).
• If delivery fails due to incorrect address, absence, or refusal to accept, additional fees may apply.

9. Service Fees and Pricing Changes

GasLite applies a service fee of 2.75% to each order to cover platform, payment, and support costs. Prices and fees are subject to change at any time. The applicable rates will always be shown before order confirmation.

10. Intellectual Property

All trademarks, logos, software, text, designs, and other content within the GasLite platform are the exclusive property of GasLite or its licensors. You may not reproduce, modify, or use our intellectual property without prior written consent.

11. Personal Data and Privacy (POPIA Notice)

GasLite collects and processes personal information in accordance with the Protection of Personal Information Act (POPIA). This includes:

• Name, contact details, address, and order history;
• Geolocation data used for delivery and driver matching;
• Payment and transaction information (processed by third parties).

We use your data solely to:

• Provide and improve Services;
• Facilitate deliveries and payments;
• Ensure user and delivery safety;
• Communicate updates and support.

You have the right to access, correct, or request deletion of your personal data. See our Privacy Policy for full details.

12. Limitation of Liability

To the fullest extent permitted by law:

• GasLite shall not be liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill.
• GasLite’s total liability for any claim shall not exceed the total amount you paid for the relevant order.
• GasLite provides Services on an “as-is” basis and does not guarantee uninterrupted availability or error-free operation.

13. Termination and Suspension

GasLite may suspend or terminate your account or restrict access to Services at any time without notice if:

• You breach these Terms;
• Provide false information;
• Abuse or misuse the platform;
• Engage in unsafe or fraudulent conduct.

14. Dispute Resolution

If a dispute arises, the parties agree to first attempt an amicable resolution. If unresolved, the dispute shall be referred to arbitration in Johannesburg, under the rules of the Arbitration Foundation of Southern Africa (AFSA). The arbitrator’s decision shall be final and binding.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict-of-law principles.

16. Changes to These Terms

GasLite may update or modify these Terms at any time. Revised versions will be posted on our website or app and take effect immediately upon publication. Continued use of the Services after any update constitutes acceptance of the revised Terms.
